The 25th Amendment to the U.S. Constitution is a critical yet often misunderstood component of our democratic process. It allows for the removal of a sitting President under specific conditions, ensuring that the highest office in the land is always occupied by someone capable of fulfilling its demanding duties. However, invoking this amendment is a complex and arduous process, reflecting the high threshold set by our Founding Fathers to prevent frivolous or politically motivated actions.
The Process of Invoking the 25th Amendment
The 25th Amendment authorizes any member of both houses of Congress to declare the President unable to perform their duties, provided a majority of that body signs the letter. Crucially, the Vice-President must also sign this declaration, regardless of its origin. If this unlikely event occurs, Vice-President Kamala Harris would immediately assume the presidency. Congress then has 48 hours to conviene to begin discussions and 21 days to vote, requiring a two-thirds majority in both houses for the Vice-President to become President permanently.
This high bar for removing a sitting President underscores the seriousness of such an action. Initiating the process, particularly if the cabinet is unwilling, can originate from either chamber of Congress. However, the process is intentionally onerous, designed to ensure that it is only used in the most extreme and clear-cut situations.
The Reality of the Situation
The high hurdle for invoking the 25th Amendment begs the question: If my Party, the GOP genuinely believes President Biden is unable to perform his duties, why have they not written, circulated, and transmitted the letter to Vice-President Harris? The process is time-consuming and fraught with challenges, particularly since the Vice-President essentially has veto power that cannot be overridden.
Impeachment, by contrast, is a more straightforward path. It requires a simple majority in the House of Representatives and a two-thirds majority in the Senate. This bypasses the Vice-President’s veto power, making it a more feasible option if there is a genuine belief that the President has committed high crimes or misdemeanors.
Our representative republic is a fragile piece of fine china, and each time we undermine the process, we add another crack, weakening the very foundations of our democracy. That piece of fine china has many cracks already, removal of a President for anything other than high crimes and treason will shatter that china into hundreds of pieces, once that happens it cannot be put back together.
The Importance of Due Process
The hurdle for removing a sitting President is extraordinarily high. This is intentional, reflecting the seriousness and potential consequences of such an action. If members of my party are earnest about invoking the 25th Amendment, don’t call on someone else to do what you have the authority to do. Have the courage to proceed and be prepared to face the consequences.
The removal of a sitting President should only ever be discussed if the President has committed high crimes and treason. The Responsibility of Our Representatives
I get frustrated when our representatives fail to understand the very processes and significance of the consequences they are elected to protect and defend, namely, the Constitution. If you genuinely believe invoking the 25th Amendment is necessary, then act on it. However, I doubt many understand or care to know that they could initiate this process.
Anyone with a platform must understand their power. There is a stark difference between making a considered decision based on the Constitution and engaging in mob mentality. Mob mentality is real and it is dangerous as seen on January 6 and July 13.
I respect our process and the office of the Presidency so much that, no matter who holds the office, it should always be determined by the people. Calls for action should not be driven by the desire for “an urgent donation of $5, $10, or even $25 to preserve our blah… blah… blah…” but by genuine concern for the well-being of our nation and adherence to our constitutional principles.
Understanding the gravity and complexity of the 25th Amendment is essential for all Americans. It’s a safeguard for our democracy, ensuring that only in the most severe circumstances can a President be removed from office, always with the highest respect for the will of the people and the rule of law.
